It is again urged that the evidence does not show a taking of the Citys sewage disposal plant. In the leading case of Pumpelly v. Green Bay Company, 13 Wall. 166, 20 L. ed. 557, Mr. Justice Miller, speaking for the Supreme Court of the United States, said: "[W]here real estate is actually invaded by superinduced additions of water, earth, sand or other materials, or by having any artificial structure placed on it, so as to effectually destroy or impair its usefulness, it is a taking within the meaning of the Constitution, * * * this proposition is not in conflict with the weight of judicial authority in this country, and certainly not with sound principle."
